2. Acceptance of Terms

By engaging our services, accessing our website, or submitting an inquiry through our contact forms, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use our services. By using our services, you represent and warrant that you meet these requirements.

3. Service Description

Nimrath provides property rental facilitation services in Kuala Lumpur and surrounding areas, including:

  • Property sourcing based on client requirements
  • Arrangement and accompaniment of property viewings
  • Property assessment and condition reporting
  • Lease negotiation with property owners
  • Review and explanation of tenancy agreements
  • Coordination of lease signing and key handover
  • Post-lease support for maintenance coordination

Our services are subject to availability and may be modified or discontinued at our discretion. We reserve the right to refuse service to any client at any time.

4. Service Limitations

Please note the following limitations of our service:

  • We act as facilitators and agents; we do not own the properties we present
  • Property availability is subject to change without notice
  • Final lease terms are subject to property owner approval
  • We cannot guarantee that you will secure a specific property
  • Property conditions may change between viewing and lease commencement
  • We are not responsible for property owner decisions or actions

5. Client Responsibilities

As a client using our services, you agree to:

  • Provide accurate and truthful information about your requirements and circumstances
  • Submit complete and genuine documentation as required for lease applications
  • Attend scheduled viewings or notify us promptly if you cannot attend
  • Conduct yourself professionally and respectfully during property viewings
  • Review tenancy agreements carefully before signing
  • Honor financial obligations outlined in lease agreements
  • Communicate any concerns or changes in your situation promptly
  • Comply with all applicable Malaysian laws and regulations

6. Fees and Payment

Our service fees are discussed during the initial consultation and agreed upon before work commences. Payment terms include:

  • Service fees are separate from property rental payments, deposits, and utilities
  • Fees are payable according to the payment schedule provided in your service agreement
  • All fees are quoted in Malaysian Ringgit (RM) unless otherwise specified
  • Payment methods accepted include bank transfer and approved electronic payment systems
  • Fees are non-refundable once services have been rendered

Any additional costs (such as property deposits or utility connections) are the client's responsibility and are paid directly to the relevant parties.

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Nimrath or its content suppliers and is protected by Malaysian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

Property listings, photographs, and descriptions provided by property owners remain the intellectual property of their respective owners and are used with permission for the purpose of rental facilitation.

8. Confidentiality

We treat all client information with confidentiality in accordance with our Privacy Policy and the Personal Data Protection Act 2010. However, certain information may be shared with property owners or third parties as necessary to facilitate rental transactions, with your consent.

You agree to keep confidential any proprietary information about properties, owners, or our business practices that you learn through our service.

9. Disclaimers

Our services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, including but not limited to:

  • The accuracy, completeness, or reliability of property information
  • The suitability of any property for your particular needs
  • The achievement of specific lease outcomes
  • The behavior or reliability of property owners or third parties
  • Uninterrupted or error-free operation of our website

We do not provide legal, financial, or tax advice. You are encouraged to seek independent professional advice regarding rental transactions, tenancy agreements, and related matters.

10. Limitation of Liability

To the maximum extent permitted by Malaysian law, Nimrath, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • Your use or inability to use our services
  • Property conditions, defects, or misrepresentations
  • Actions or omissions of property owners or other third parties
  • Rental disputes or lease terminations
  • Loss of data, profits, or opportunities

Our total liability for any claims arising from our services shall not exceed the total fees paid by you to Nimrath for the specific transaction giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Nimrath, its directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms and Conditions
  • Your violation of any rights of third parties
  • Your use of our services
  • Information you provide to us or property owners

12. Termination

Either party may terminate the service relationship at any time with written notice. Upon termination:

  • You remain responsible for any fees incurred for services already rendered
  • We will cease active property sourcing on your behalf
  • Confidentiality obligations continue after termination
  • Any ongoing lease arrangements continue according to their terms

We reserve the right to terminate services immediately if you breach these Terms and Conditions or engage in conduct we deem inappropriate.

13. Dispute Resolution

In the event of any dispute arising from these Terms and Conditions or our services, the parties agree to first attempt resolution through good faith negotiation. If negotiation does not resolve the dispute within thirty days, the parties may pursue mediation before resorting to litigation.

Any legal proceedings shall be conducted exclusively in the courts of Kuala Lumpur, Malaysia, and shall be governed by the laws of Malaysia.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, including but not limited to:

  • The Contracts Act 1950
  • The Personal Data Protection Act 2010
  • Regulations governing estate agents and property rental

15. General Provisions

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Nimrath regarding our services.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.

16. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
